1. Agreement

These Terms govern your access to and use of Fens, including its website, accounts, game systems, virtual currencies, community features, and paid digital content. By creating or using a Keeper account, you agree to these Terms, the Privacy Policy, the Rules & safety policy, and, when you make a purchase, the Purchase & refund policy.

2. Eligibility

Fens is intended only for people who are at least 18 years old. By creating an account, you represent that you are 18 or older. Fens does not knowingly permit minors to maintain Keeper accounts. If you believe a minor is using Fens, contact us at the address above.

3. Accounts and Google sign-in

New Keeper accounts use Google authentication through Supabase. Google may provide Fens with your name, email address, profile picture, and a provider-specific account identifier after you authorize sign-in. Fens does not receive your Google password. You choose a separate public Keeper name during onboarding.

You are responsible for activity performed through your account and for keeping access to your Google account secure. Unless Fens expressly permits otherwise, each person may maintain only one Keeper account. You may not sell, rent, share, or transfer your account.

4. The game and your license

Fens grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and play the Game for lawful personal entertainment. Fens, its software, artwork, world, characters, systems, text, and other operator-created materials remain the property of the operator or applicable licensors.

5. Virtual currencies, items, and game value

Fens currently uses virtual resources including Marks, Gleam, and other game-specific balances or chips. These are game-content licenses and accounting units, not money, bank deposits, securities, or stored cash.

• Gleam may be earned in-game or purchased for real money where offered.
• Where the official Gleam Market is available, players may exchange Gleam for Marks through Fens' in-game systems.
• Marks may be earned, spent, and traded through Fens' ordinary game economy, but Marks and Gleam are not accepted as stakes in Fens' casino-style games or spectator forecasts.
• House Chips are free, nontransferable play currency issued by Fens for casino-style minigames. They cannot be purchased with Marks or Gleam and cannot be redeemed into Marks, Gleam, cash, or other transferable game value.
• No Fens currency, item, account, creature, or other game asset is redeemable from Fens for cash, cryptocurrency, or other real-world value.
• Off-platform real-money trading, including sales through marketplaces, auctions, private payments, cryptocurrency, or similar arrangements, is prohibited.

Game balances do not represent a vested property interest. Fens may rebalance, cap, rename, retire, correct, or reverse virtual balances when reasonably necessary for game balance, fraud prevention, error correction, enforcement, refunds, chargebacks, or service changes, subject to applicable law.

6. Purchases and Stripe

Paid Gleam purchases are one-time digital purchases processed by Stripe. Before checkout, Fens displays the amount of Gleam and the purchase price. Stripe processes your payment credentials; Fens does not receive or store your full card number or card security code. Fens does receive limited transaction information needed to create, verify, fulfill, support, refund, and reconcile purchases.

Purchases are subject to the Purchase & refund policy. Nothing in these Terms limits non-waivable consumer rights that apply where you live.

7. Chance-based games, competitions, and forecasts

Fens may include optional casino-style minigames played with free House Chips and spectator Forecasts made with free Forecast Slips. House Chips and Forecast Slips are isolated from the Marks and Gleam economies: they are not sold, transferable, redeemable, or convertible into Marks, Gleam, cash, cryptocurrency, or other real-world value. Forecasts award progression and account-bound recognition rather than a wager payout.

You must not use Fens to arrange real-money side bets, off-platform settlements, cash prizes, match fixing, outcome manipulation, or any other scheme that converts a Fens game outcome into an unauthorized real-world payment. Fens may limit, suspend, modify, or remove these features where required for safety, compliance, payment-processor requirements, or game balance.

8. User content

You retain ownership of content you create and submit to Fens to the extent you own it. You grant Fens a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, distribute, and use that content as reasonably necessary to operate, moderate, promote, improve, archive, and protect Fens. This license ends when the content is deleted from Fens except for copies reasonably retained in backups, moderation records, legal records, or content already shared publicly by other users.

You may submit only content you have the right to use. You are responsible for your usernames, messages, images, posts, creature names, and other submitted material.

9. Rules and fair play

The Rules & safety policy is part of these Terms. Among other things, it prohibits cheating, unauthorized automation, harassment, scams, economy manipulation, real-money trading, collusion, and abusive behavior.

10. Suspension and termination

Fens may warn, restrict, suspend, or terminate accounts, reverse abusive transactions, remove content, or limit features when reasonably necessary to enforce these Terms, protect players or the service, investigate fraud, comply with law, or respond to payment disputes. Where practical, enforcement will be proportionate to the issue. Refund rights remain governed by applicable law and the Purchase & refund policy.

11. Availability and changes

Fens is an evolving online game. Features, economies, rules, content, pricing, availability, and technical requirements may change. We do not promise uninterrupted availability or that any particular item, feature, market rate, creature, balance, or game system will remain unchanged forever.

12. Privacy and data

Our data practices are described in the Privacy Policy. You may request account deletion by contacting [email protected]. Some limited records may be retained where reasonably necessary for security, fraud prevention, dispute resolution, accounting, or legal obligations.

13. Disclaimers

To the maximum extent permitted by law, Fens is provided on an “as is” and “as available” basis without warranties of uninterrupted operation, error-free performance, or preservation of every item or game state. Nothing in this section excludes warranties or remedies that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of Fens. Any limitation applies only to the extent permitted by applicable law and does not limit liability that cannot legally be limited.

15. Governing law and disputes

These Terms are governed by Nevada law, without overriding consumer protections that must apply under the law of your residence. Before filing a claim, you and Fens agree to make a reasonable good-faith effort to resolve the issue informally by email. Unless applicable law requires another forum, disputes may be brought in a court of competent jurisdiction in Clark County, Nevada. These Terms do not require arbitration and do not waive rights that cannot lawfully be waived.

16. Changes to these Terms

We may update these Terms as Fens changes. Material changes will receive a new effective date or version. When appropriate, Fens may require renewed acceptance before continued account use.
